These Terms govern access to and use of the Platform. Kivo Credit is a technology platform and is not a lender, NBFC, or bank.

Introduction & Acceptance

These Terms & Conditions ("Terms") govern access to and use of the website www.kivocredit.com, related mobile applications, and services (together, the "Platform") operated by [Kivo Credit Legal Entity Name], a company incorporated under the Companies Act, 2013, bearing Corporate Identity Number (CIN) [CIN Number] ("Kivo Credit", "we", "us", or "our").

By visiting the Platform, creating an account, submitting a loan application, or accepting a loan offer, you ("User", "Borrower", or "you") confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and the Key Fact Statement (KFS), sanction letter, and loan agreement applicable to your loan.

These Terms constitute an electronic record under the Information Technology Act, 2000 and rules made thereunder, and are published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. We may amend these Terms from time to time; the revised Terms will be posted on this page with an updated "Last updated" date, and continued use of the Platform after such changes constitutes acceptance, to the extent permitted by law.

About the Platform

Kivo Credit is a technology platform that helps eligible customers explore and access financial products such as personal loans and salary advances. Kivo Credit is not a lender, a non-banking financial company (NBFC), or a bank. We do not sanction, disburse, or hold any loan on our own account.

All loans made available through the Platform are provided by our regulated lending partner(s) (each, a "Lending Partner"), who are banks and/or NBFCs registered with the Reserve Bank of India (RBI). Loan approval, pricing, interest rate, tenure, and disbursal are determined solely by, and are subject to the credit policies of, the applicable Lending Partner.

Kivo Credit's role is limited to facilitating discovery, eligibility checks, application submission, document collection, and post-disbursal support on behalf of the Lending Partner, acting as a Lending Service Provider / Digital Lending App as applicable under RBI's Digital Lending Guidelines.

Eligibility

To apply for a loan or salary advance through the Platform, you must:

  • Be an Indian citizen and resident in India;
  • Be at least 21 years and not more than [58] years of age;
  • Be a salaried employee or eligible self-employed individual meeting the minimum income criteria specified on the Platform;
  • Hold a valid Permanent Account Number (PAN) issued by the Income Tax Department, India;
  • Hold an active bank account with a scheduled commercial bank in India;
  • Be competent to contract under the Indian Contract Act, 1872 (minors and undischarged insolvents are not eligible); and
  • Provide accurate, complete, and current information at every stage of the application.

Meeting these criteria does not guarantee loan approval. Approval, loan amount, and terms are at the sole discretion of the applicable Lending Partner and subject to its internal credit, KYC, and regulatory checks.

Application, Registration & KYC

To apply, you must complete the online application on the Platform and provide the documents/information requested, including identity proof, address proof, income proof, and bank account details.

By submitting an application, you authorise Kivo Credit and the relevant Lending Partner to:

  • Verify your identity, employment, income, and financial information;
  • Obtain your credit report and credit score from Credit Information Companies (CICs) such as CIBIL, Experian, Equifax, or CRIF Highmark, with your consent;
  • Conduct fraud checks, address/employment verification, and risk assessment; and
  • Contact you via phone call, SMS, email, WhatsApp, or push notification regarding your application, loan, or account.

Providing false, misleading, or incomplete information may result in rejection of your application, cancellation of an approved offer, recall of disbursed funds (where legally permissible), and/or reporting to regulators or law-enforcement authorities as required by law.

Loan Terms, Fees & Disclosures

Loan amount, tenure, interest rate, Annual Percentage Rate (APR), processing fee, and other applicable charges are determined by the Lending Partner and disclosed to you in the Key Fact Statement (KFS) and sanction letter before you accept any loan offer. Indicative product parameters made available through the Platform include:

  • Loan amount range: ₹[xx,xxx] to ₹[x,xx,xxx] (subject to eligibility and Lending Partner policy);
  • Repayment tenure: [x] months to [xx] months;
  • Rate of interest (ROI): Up to [xx]% p.a. (as set by the Lending Partner);
  • Maximum APR: Up to [xx]% p.a., inclusive of all applicable charges.

Actual approved terms may vary based on your credit profile and the Lending Partner's assessment. Late payment charges, bounce/dishonour charges, and any other fees, where applicable, will be specified in your KFS and loan agreement and will never be charged without prior disclosure.

Key Fact Statement (KFS) & Sanction

In compliance with RBI's Digital Lending Guidelines and Fair Practices Code, a Key Fact Statement containing all material terms of the loan — including loan amount, ROI, APR, tenure, EMI amount, penal charges, cooling-off period, and grievance contact details — will be provided to you before you accept the loan offer.

Your loan is sanctioned by the Lending Partner only after you review and explicitly accept the KFS, sanction letter, and loan agreement. No disbursement will be made without your informed consent to the disclosed terms.

Disbursal

Upon successful verification, sanction, and your acceptance of the loan documents, the approved loan amount will be credited directly by the Lending Partner to your designated bank account, as specified in the KFS.

Disbursal timelines are indicative and depend on completion of KYC, document verification, and banking processes. Kivo Credit is not liable for delays caused by incorrect bank details provided by you, or by third-party banking systems and processes beyond our reasonable control.

Repayment

You agree to repay the loan strictly in accordance with the EMI schedule, due dates, and payment mode specified in your loan agreement and KFS. Repayment may be made through NACH/e-NACH, UPI Autopay, bank transfer, or such other modes as may be permitted by the Lending Partner.

EMI reminders and payment confirmations may be sent to your registered mobile number and email address. You are responsible for maintaining sufficient balance in your linked bank account on each due date. Credit of payments to your loan account may take up to 2–3 business days depending on the payment channel and bank processing timelines.

Default, Overdue & Collections

Failure to pay any EMI or amount due on time may constitute a default under your loan agreement with the Lending Partner. Consequences may include:

  • Levy of late-payment or penal charges as disclosed in the KFS;
  • Reporting of the default to Credit Information Companies, which may adversely affect your credit score; and
  • Initiation of lawful recovery proceedings by or on behalf of the Lending Partner.

Kivo Credit and its Lending Partners follow RBI's Fair Practices Code and Digital Lending Guidelines. Neither Kivo Credit nor any recovery agent engaged on our or the Lending Partner's behalf will engage in harassment, intimidation, or unauthorised disclosure of your personal information during the recovery process.

Prepayment & Foreclosure

You may prepay or foreclose your loan in accordance with the terms specified in your KFS and loan agreement. Any prepayment or foreclosure charges, if applicable, will be disclosed upfront in the KFS. Where no such charge is stated, prepayment shall be permitted without additional fees, subject to the loan agreement.

Cooling-Off / Look-Up Period

As required under RBI's Digital Lending Guidelines, a cooling-off (look-up) period will be specified in your KFS, during which you may exit the loan by paying only the principal amount and proportionate APR, without any penalty. Please review your KFS carefully for the exact duration and applicable conditions before accepting a loan offer.

Suspension & Termination of Access

We may suspend or terminate your access to the Platform, or decline or cancel a loan application, if you breach these Terms, provide false or misleading information, engage in fraud, misuse the Platform, or if required to do so by law, the Lending Partner, or a regulatory direction.

You may request closure of your Platform account after all loan obligations to the Lending Partner are fully settled, subject to statutory record-keeping requirements applicable to Kivo Credit and the Lending Partner.

User Conduct & Prohibited Use

You agree that you shall not:

  • Use the Platform for any unlawful, fraudulent, or unauthorised purpose;
  • Impersonate any person or misrepresent your identity, employment, or financial status;
  • Attempt unauthorised access to, or interfere with, scrape, or reverse-engineer the Platform's systems;
  • Upload or transmit any harmful, defamatory, obscene, or unlawful content; or
  • Use the Platform's content for commercial resale or unauthorised reproduction.

Intellectual Property

All content, trademarks, logos, software, and materials on the Platform are owned by or licensed to Kivo Credit and are protected under applicable intellectual property laws. You may not copy, modify, distribute, publish, or otherwise exploit any content available on the Platform without our prior written consent.

Disclaimer & Limitation of Liability

The Platform and the information made available on it are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Kivo Credit disclaims all warranties regarding uninterrupted or error-free access, the accuracy of third-party data, or fitness for a particular purpose.

Kivo Credit shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform, or from any act, omission, delay, or decision of a Lending Partner, except where such liability cannot be excluded under applicable law. Nothing in these Terms limits any statutory rights you may have as a consumer or borrower under Indian law.

Privacy

Our collection, use, storage, and disclosure of your personal data is described in our Privacy Policy, available at www.kivocredit.com/privacy-policy. By using the Platform and submitting an application, you acknowledge that you have read and understood the Privacy Policy and consent to the processing of your data as described therein, including sharing of your data with the applicable Lending Partner for the purpose of loan assessment and servicing.

Grievance Redressal

For any complaints or grievances relating to your loan application, loan servicing, data privacy, or use of the Platform, you may contact our Grievance Redressal Officer:

We aim to acknowledge grievances within 1 business day and resolve them within the timelines prescribed under RBI's grievance redressal norms (ordinarily within 5–30 business days depending on the nature of the complaint). If you remain dissatisfied with our response, you may escalate the matter to the Grievance Redressal Officer of the applicable Lending Partner, or to the RBI Ombudsman for Digital Lending, as applicable.

Force Majeure

Kivo Credit shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including natural disasters, war, strikes, internet or telecommunications failures, governmental action, or regulatory directions.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection and regulatory remedies available to you, the courts at [City, e.g. New Delhi] shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
